Terms of Use

These Terms of Use are an agreement between you and Daily Method (“we”, “us”) for using DMO at https://dailymethod.app, its Studio subdomains and related services (the “Service”). By creating an account, joining a Studio or using the Service, you agree to these Terms and to our Privacy Policy.

If you use the Service for an organisation, you confirm you can bind it, and “you” includes that organisation.

• You must be at least 16 and give accurate information.
• Keep your password safe; you're responsible for activity on your account. Tell us at once if you think it's been misused.
• One person per account. Don't share logins or create accounts for others without their permission.

A Studio is a space a person or organisation creates on DMO. The Studio's owner, and the admins they appoint:

• decide who can join, what each member can see and do, and which features are on;
• are responsible for their Studio's content, settings, plans and prices, and for how they use their members' information, including complying with privacy, consumer-protection and anti-spam laws that apply to them;
• can remove or suspend members within their Studio.

Members agree to follow the rules of the Studios they join, in addition to these Terms.

You keep ownership of what you post or upload. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and process it only as needed to run the Service for you and your Studios (for example, to show your post to the members of a space, or to make a thumbnail). The licence ends when the content is deleted, except for copies kept in backups for a limited time or as the law requires.

You're responsible for your content and confirm you have the rights to share it, including any personal information about other people (for example leads, bubble chart entries or photos).

Don't use the Service to:

• break the law, or infringe anyone's intellectual property, privacy or other rights;
• harass, threaten, defame or discriminate against others, or share hateful, sexually explicit or violent content;
• send spam or unsolicited messages, or contact people captured through member cards or Team Hub without the consent the law requires;
• upload malware, probe or break our security, or get around access controls, rate limits or Studio permissions;
• scrape the Service or use it to build a competing product;
• impersonate others, or misrepresent your identity or your connection to a Studio.

We may remove content or limit accounts that break these rules.

Member cards let people leave their details for you. If you use them, you're responsible for:

• using captured details only to follow up as the person expects;
• meeting anti-spam and privacy laws (such as Canada's CASL, the US CAN-SPAM Act and the GDPR) when you contact them;
• honouring requests to stop contacting them or to delete their details.

• Studio plans: Studios can sell memberships, courses and plans to their members. The Studio is the seller and sets prices, refunds and cancellation terms. Payments are processed by Stripe on the Studio's connected account, and Stripe's terms apply.
• Platform fees: DMO may charge Studios a platform fee or subscription, as shown when they choose a plan.
• Subscriptions renew automatically until cancelled. You can cancel from the billing pages or the Stripe customer portal; access continues to the end of the paid period.
• Taxes: prices may exclude taxes, which are added where required.

Questions about a purchase from a Studio should go to that Studio first.

Run Mode points, goals, rings and team results are estimates calculated from the product rates (such as FYC values) and formulas a Studio enters. They're tools for tracking activity, not commission statements, payroll records, contracts, or financial, legal or tax advice. Check figures with the relevant institution or your organisation before relying on them.

If a Studio turns on DMO AI, summaries, drafts and suggestions are generated automatically and can be wrong or incomplete. Review AI output before using or sharing it; you're responsible for what you publish.

The Service connects to third parties (for example Stripe, email delivery, video and embed providers, Apple and Google Wallet, and websites linked from training or checklist items). Their own terms and policies apply, and we're not responsible for their content or services.

The Service, its software and design, and the DMO name and marks belong to Daily Method or its licensors. These Terms give you a limited, revocable, non-transferable right to use the Service as intended. If you send us feedback, we may use it without obligation to you.

We work to keep the Service available and secure, but it's provided as is and as available. We may change, add or remove features (including features a platform administrator switches on or off for a Studio), and we may need to suspend it for maintenance. We'll try to give notice of significant changes.

You can stop using the Service at any time, and ask us to close your account at support@dailymethod.app. Studio owners can delete their Studio's content.

We may suspend or end access to an account or a Studio if these Terms are broken, if required by law, or to protect the Service or other users, with notice where reasonable. Sections that by their nature should survive (such as ownership, disclaimers, liability and governing law) continue after termination.

To the extent the law allows, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that content posted by others is accurate.

To the extent the law allows, Daily Method won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $100. Some places don't allow these limits, so they may not apply to you, and nothing here limits liability that can't be limited by law.

You agree to defend and indemnify Daily Method against claims arising from your content, your use of the Service in breach of these Terms or the law, or (for Studio owners) the operation of your Studio, including how you use your members' and leads' information.

These Terms are governed by the laws of Canada and of the province in which Daily Method is established, without regard to conflict-of-law rules, and disputes will be heard by the courts there, unless the law where you live gives you the right to bring proceedings elsewhere. Before starting proceedings, please contact us so we can try to resolve the issue informally.

We may update these Terms. The effective date at the top shows the current version. For significant changes we'll give notice in the app or by email before they take effect. If you keep using the Service after that, you accept the updated Terms.
